Exploring the Interface Between the Common Law of Tort and Statute Law

On 29 November 2023 Lord Philip Sales – Justice of the Supreme Court of the United Kingdom since 11 January 2019 – spoke on the above topic to the UK Personal Injuries Bar Association. The article addresses the important modern issue of the role of legislation in grounding or obviating the existence of a tortious duty of care, and if grounded then in moulding the content of that duty.
